CONTENT USAGE GUIDELINES
FOR IRRESISTIBLE CHURCH NETWORK
FAMILY MINISTRY CURRICULUM
1. GENERAL GUIDELINES:
These Content Usage Guidelines (“Usage Guidelines”) supplement the Content License Agreement (“Agreement”) your Organization entered into with North Point Ministries, Inc., d/b/a/ Irresistible Church Network (“ICN”). Organization’s use of ICN Content and Trademarks must comply with these Usage Guidelines and the License terms of the Agreement. Capitalized terms in these Usage Guidelines are defined in the applicable Agreement.
Access to and use of the Content and Trademarks under the License is restricted to Organization staff, volunteers, members, and participants in Organization’s ministry environments solely to conduct Organization’s children’s, youth, adult, or other ministry environment(s) for which the Content is designated by ICN.
Any Content which is not expressly designated by ICN as “editable” may not be revised or edited.
No Trademark may be edited, changed, or adapted in any manner.
2. CONTENT LICENSE:
Organization may adapt elements of the Content designated by ICN as “editable” to create ministry materials contextualized for Organization, including original videos and live productions (collectively, “Adaptations”), provided that: (i) the Adaptations are reproduced, distributed, displayed, or performed solely in the ministry environment operated by Organization for which the Content is designated by ICN and during the Term set forth in the License; (ii) the Adaptation is not distributed outside your Organization or sold; and (iii) the Adaptation complies with the terms of the License, including maintaining a high level of integrity, quality, and Biblical consistency, consistency with the North Point Community Church “What We Believe” statement, and not changing the underlying meaning of the Content.
The Content and any Adaptations may be delivered solely as part of Organization’s ministry environment.
Music/audio and video files provided by ICN (if any) for download or use as part of a curriculum License may be used by Organization as follows during the License Term:
Playback on Organization premises: unlimited.
Permission to burn track to CD/DVD or storage device: unlimited as necessary to distribute to employees and volunteers that are a part of your Organization as necessary to facilitate Organization’s ministry environment.
Any reproduction for sale or distribution is strictly prohibited.
Notwithstanding any other provision of these Usage Guidelines or the Agreement, Organization is solely responsible for obtaining all blanket music licenses necessary to publicly perform, stream, distribute, and sync music that is included in the Content and Organization agrees not to use any music included in the Content without first securing all necessary licenses.
EXCEPT FOR ELEMENTS OF CONTENT WHICH ICN EXPRESSLY AUTHORIZES ORGANIZATION IN WRITING TO MAKE PUBLICLY AVAILABLE (E.G. SOCIAL MEDIA ANNOUNCEMENT POST PROVIDED BY ICN), POSTING OR LIVESTREAMING THE DELIVERY OF CONTENT, TRADEMARKS, OR ADAPTATIONS LICENSED UNDER AN ICN LICENSE, IN WHOLE OR IN PART, ON UNSECURED OR PUBLIC WEBSITES OR SOCIAL MEDIA CHANNELS (E.G. YOUTUBE OR INSTAGRAM) IS STRICTLY PROHIBITED AND WILL AUTOMATICALLY VOID THE LICENSE GRANTED TO ORGANIZATION UNDER THE AGREEMENT.
USE OF ANY ICN CONTENT OR TRADEMARKS IN FOR-SALE OR COMMERCIAL PRODUCTS OR SERVICES IS STRICTLY PROHIBITED AND WILL AUTOMATICALLY VOID THE LICENSE GRANTED TO ORGANIZATION UNDER THE AGREEMENT.
3. TRADEMARKS
ICN Trademarks may only be reproduced and displayed in connection with Organization’s ministry environment for which the underlying Trademark is designated by ICN. Organization agrees to use the Trademarks in the form provided by ICN without alteration of any kind and to include the trademark notices (“™” or “®”) used by ICN with each display of the Trademarks. The trademark license does not include the right to use any trademark in Organization’s name or in connection with a for-sale product or service offered by Organization. Any use of a trademark in text should be in ALL CAPS with the appropriate trademark notice (e.g. NORTH POINT MINISTRIES®). All use of the Trademarks must comply with the ICN trademark style guide as it may be revised from time to time. The license of ICN Trademarks applies in those jurisdictions in which ICN owns or controls rights to the applicable Trademarks.
4. EXPIRATION
Organization agrees to cease all use of the ICN Content, Trademarks, and Adaptations upon expiration or termination of the applicable Agreement. Additionally, all copies of Content accessed through the License and stored by Organization on any hard drive, cloud-based storage, other storage device or method, or in hard copy must be deleted or destroyed upon expiration or termination of the License.
5. RESPONSIBILITY FOR USERS
Organization is responsible for it and its users compliance with these Usage Guidelines and the terms of the Agreement. It is the responsibility of Organization to inform each of its users of the restrictions applicable to use of the Content and Trademarks under these Usage Guidelines and the Agreement, and to enforce them. Organization may share its login information with Organization staff and volunteers to access the Content. Organization is legally responsible for all use of its account and all login information associated with its account. All users of a License acknowledge their access to the Content may be limited at any time due to the terms of the specific License purchased or restrictions placed on an Organization account. To the extent Organization shares any Content with its employees or staff through electronic means, Organization shall ensure that the Content is password protected and is protected by industry standard cybersecurity measures.
6. PRIVACY
Any data Organization’s users provide to ICN or which ICN or its affiliates obtain related to user’s use of ICN Content, including personally identifiable information, will be governed by the ICN Privacy Policy, which may be amended from time to time. You, individually, or you, on behalf of your Organization, agree that the ICN Privacy Policy is incorporated herein by reference and any updated ICN Privacy Policy terms become part of the Agreement upon ICN posting those terms publicly on any ICN website. Any conflict between these Usage Guidelines and the ICN Privacy Policy will be governed by these Usage Guidelines.
7. TERMINATION
If Organization or any user under Organization’s account violates these Usage Guidelines, the Agreement, or engages in other conduct which ICN deems potentially harmful or disruptive to ICN or any other ICN users (which conduct may include, without limitation, use of obscene, defamatory, libelous, threatening, or harassing language, impersonating or intimidating any person or falsely stating or otherwise misrepresenting affiliation with any person, using any ICN website, Organization’s ICN account, or Content or Trademarks in connection with any chain letters, junk mail, mass communication through any form or other spamming or multi-level marketing, or using any ICN website, Organization’s ICN account, or Content or Trademarks to participate in any conduct or activity that violates laws of the United States or any state therein, including without limitation laws governing the transmission of technical data exported from the United States through the Internet and other electronic media) ICN reserves the right to terminate Organization’s access to the ICN Content and Trademarks, and/or Organization’s Agreement and License.
8. NOT TRANSFERABLE
The individual elements of the Content and Trademarks are licensed (not sold) by ICN and/or its licensors for personal, non-commercial, ministry use pursuant to the terms of the Agreement and only by the Organization which purchases the License. Organization is not authorized to share the Content or Trademarks with any other person or third-party organization, or to grant permission for any other person or third-party organization to use them.
