SUBSCRIPTION USAGE GUIDELINES
GENERAL GUIDELINES:
These guidelines supplement the terms of the Content License Agreement you or your organization entered into with North Point Ministries (“NPM”) for the use of NPM Content and/or Trademarks as part of a North Point Partner subscription. You or your organization are not authorized to use NPM Content or Trademarks except pursuant to the license in that agreement. Your or your Organization’s use of NPM Content must comply with these Usage Guidelines and the license terms of the Content License Agreement. Capitalized terms in these Usage Guidelines are defined in the applicable Content License Agreement
For Licenses purchased by Organizations, access to and use of the Content and Trademarks is restricted to Organization staff, volunteers, members, and regular attendees solely to provide training for the operation of your Organization’s ministry program.
For Licenses purchased by Individuals, access and use is limited to the specific item(s) of Content covered by the Subscription, use of the Content is expressly limited to personal use by the Individual subscriber only, and the Individual acknowledges he or she is not permitted to use the Trademarks nor to reproduce, adapt, edit, or display the Content except for personal use. Individual subscribers may not view, share, or stream the Content with any other person.
Any Content which is not expressly designated by NPM as “editable” may not be revised or edited.
POSTING CONTENT, TRADEMARKS, OR ADAPTATIONS LICENSED UNDER AN NPM SUBSCRIPTION, IN WHOLE OR IN PART, ON UNSECURED OR PUBLIC WEBSITES (E.G. YOUTUBE) AND USE OF ANY NPM CONTENT OR TRADEMARKS IN FOR-SALE OR COMMERCIAL PRODUCTS OR SERVICES ARE STRICTLY PROHIBITED AND WILL AUTOMATICALLY VOID YOUR LICENSE.
ORGANIZATION SUBSCRIPTIONS ONLY: VIDEO/AUDIO/MULTIMEDIA CONTENT: For Organization Subscriptions, video, audio, and/or multimedia files posted by NPM as part of a Subscription may be used by your Organization as follows during the license term solely for ministry training purposes:
Unlimited streaming from NPM platform by Organization staff, volunteers, members, and regular attendees.
Site license to display and perform for Organization staff, volunteers, members, and regular attendees on Organization’s premises and at ministry training events operated by the Organization, provided no admission fee is charged.
Video, audio, and multimedia content may not be downloaded or otherwise reproduced or distributed by Organization.
ORGANIZATION SUBSCRIPTIONS ONLY: DOWNLOADABLE TEXT AND IMAGES:
For Organization Subscriptions, certain text files of Content may be designated by NPM as “downloadable,” in which case they may be reproduced and distributed only to Organization staff, volunteers, members, and regular attendees solely for ministry training purposes during the Term set forth in the Content License Agreement.
For Organization Subscriptions, your Organization may adapt the text files designated by NPM as “downloadable” and “editable” and may develop original training materials based on concepts and text from the Content (collectively, “Adaptations”), provided that: 1) the Adaptations are reproduced, distributed, displayed, or performed solely in the applicable ministry training program operated by the Organization during the Term set forth in the Content License; and 2) the Adaptation is not distributed outside the Organization or sold.
TRADEMARKS: For Organization Subscriptions, NPM Trademarks may be reproduced and displayed in connection with the relevant ministry training program. Your Organization agrees to use the Trademarks in the form provided by NPM without alteration of any kind and to include the trademark notices (“™” or “®”) used by NPM with each display of the Trademarks. The trademark license does not include the right to use any trademark in your Organization’s name or in connection with a for-sale product or service offered by your Organization. Any use of a trademark in text should be in ALL CAPS with the appropriate trademark notice (e.g. NORTH POINT MINISTRIES®). All use of the Trademarks must comply with the NPM trademark style guide as it may be revised from time to time. The license of NPM Trademarks applies in those jurisdictions in which NPM owns or controls rights to the applicable Trademarks.
EXPIRATION: You or Your Organization agree to cease all use of the NPM Content, Trademarks, and Adaptations upon expiration or termination of the applicable Content License Agreement. Additionally, all copies of Content accessed through the license and stored by the Organization or Individual on any hard drive, cloud-based storage, other storage device or method, or in hard copy must be deleted or destroyed upon expiration or termination of the license.
RESPONSIBILITY FOR USERS: For Organization Subscriptions, it is your Organization’s responsibility to inform each user of the restrictions applicable to use of the Content and Trademarks under these Usage Guidelines, and to enforce them. Organization may share its Subscription login information with Organization staff and volunteers to access the Content. Organization is legally responsible for all use of its Subscription account and all login information associated with its account. All users of a Subscription acknowledge their access to the Content may be limited at any time due to the terms of the specific Subscription purchased or restrictions placed on an Organization account.
PRIVACY. Any data you or your Organization’s users provide to NPM or which NPM or its affiliates obtain related to user’s use of NPM Content, including personally identifiable information, will be governed by the NPM Privacy Policy, which may be amended from time to time. You, individually, or you, on behalf of your Organization, agree that the NPM Privacy Policy is incorporated herein by reference and any updated NPM Privacy Policy terms become part of this agreement upon NPM posting those terms publicly on any NPM website. If participating in a Leadership Community or other type of call group with other Organizations, user contact information, including without limitation name, picture, email address, phone number, and role at your Organization may be shared with other members of your particular Leadership Community or call group. By opting in to a Leadership Community, you and your Organization agree that other members of your specific Leadership Community may contact you or your Organization. Any conflict between these Usage Guidelines and the NPM Privacy Policy will be governed by these Usage Guidelines.
SAFETY. In order to keep websites containing NPM Content a safe environment, you and/or your Organization agrees that users from your Organization will not:
Use language that contains profanity or obscene language or that may be defamatory, libelous, threatening, or harassing;
Impersonate or intimidate any person, or falsely state or otherwise misrepresent affiliation with any person;
Use the website in connection with any chain letters, junk mail, mass communication through any form or other spamming, or multi-level marketing;
Use the website to participate in any conduct or activity that violates laws of the United States or any state therein, including without limitation laws governing the transmission of technical data exported from the United States through the Internet and other electronic media;
TERMINATION. If you, your Organization, or any user under your Organization’s account violate these Usage Guidelines or engage in other conduct which NPM deems potentially harmful or disruptive to NPM or any other NPM users, NPM reserves the right to terminate your Individual Subscription, the individual user’s access to the NPM Content and Trademarks, and/or your Organization’s Subscription.
NOT TRANSFERABLE: Your or your Organization’s license to use the NPM Content and/or Trademarks is limited to you or, in the case of Organization Subscriptions, your Organization. You and/or your Organization are not authorized to share NPM Content or Trademarks with any other person or organization, nor to grant permission for any other person or organization to use them.
